The written statement of employment particulars: a day-one right

Since April 2020 the written statement is a day-one right for employees and workers - not something you have two months to get round to.

What it must contain

  • Names of employer and employee, and the start date.
  • Pay (amount, interval, how calculated) and hours of work.
  • Holiday entitlement, job title or description, and place of work.
  • Notice periods, sick pay and other benefits, probation terms, and training entitlement.

Day-one right

The principal statement must be given on or before the first day of employment. It applies to employees and to workers, not just permanent staff.

Penalty

If an employee brings a successful tribunal claim and you never provided a proper statement, the tribunal can award two to four weeks' pay on top.
