Statutory Sick Pay: an employer's guide
SSP is a legal minimum, not a discretion. Knowing exactly who qualifies and for how long keeps you compliant and consistent.
Who qualifies
- Employees earning at least the lower earnings limit on average.
- Who have been off sick for at least four days in a row (including non-working days).
How it works
- SSP is paid at the statutory weekly rate for up to 28 weeks.
- The first three qualifying days are normally 'waiting days' (unpaid), unless the employee was recently off sick.
- Check the current SSP rate on GOV.UK - it is reviewed each April.
Records
Keep records of sickness absence and SSP paid. Many employers offer contractual sick pay above SSP - if so, it must be applied consistently.
